Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and the person or entity operating under the trade name Bring Them to Life ("Bring Them to Life," "we," "us," or "our"). They govern your use of bringthemtolife.xyz and our image-preview, animation-generation, delivery, and related services (collectively, the "Service").
By entering a promo code, uploading content, requesting an animation, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and authority
You must be at least 18 years old to use the Service. If you use it for a company, client, or other organization, you represent that you have authority to accept these Terms for that organization, and "you" includes that organization.
2. The Service
Bring Them to Life lets you upload an image, preview an isolated subject, choose a tested reaction, and request reusable animation and related delivery files. Features, file formats, providers, limits, and availability may change as we develop the Service. A promo code or private link is personal to its authorized recipient and may not be sold, shared publicly, or used to bypass limits.
3. Your content and permissions
"Input" means any image, instruction, feedback, or other material you submit. You retain whatever rights you have in your Input. You represent and warrant that:
- you own the Input or have all permissions needed to upload, transform, animate, and use it through the Service;
- the Input and your requested use do not infringe copyright, trademark, publicity, privacy, confidentiality, or other rights;
- you have informed consent from any identifiable person depicted, and from a parent or legal guardian if a minor is depicted; and
- you will comply with any license, brand, employment, agency, or client restriction that applies to the Input.
You grant us a worldwide, nonexclusive, royalty-free, limited license to host, copy, transmit, analyze, modify, generate from, display privately to you, and otherwise process Input and output only as reasonably necessary to provide, secure, troubleshoot, support, and improve the Service and to comply with law. This license ends when the material is deleted from our active systems, except for limited backup, legal, security, and dispute-resolution copies.
4. Generated output
"Output" means animation, images, previews, packages, and other files generated for you by the Service. As between you and Bring Them to Life, and subject to your rights in the Input, applicable law, and third-party rights, you may use delivered Output for lawful personal or commercial purposes. To the extent we own any rights in a delivered Output, we assign those rights to you.
AI-generated Output can contain mistakes, artifacts, unexpected changes, or similarities to material generated for others. We do not promise that Output is unique, accurate, noninfringing, or eligible for copyright, trademark, or other legal protection. You are responsible for reviewing Output and obtaining any legal or professional clearance needed before publishing, distributing, selling, or relying on it.
5. Acceptable use
You may not use the Service to:
- upload or create unlawful, infringing, defamatory, harassing, hateful, sexually exploitative, nonconsensual intimate, or privacy-invasive material;
- sexualize a minor or create content that exploits or endangers a child;
- deceive people through impersonation, fraud, fabricated endorsement, or a misleading deepfake;
- identify a person through biometric analysis, conduct surveillance, or make decisions about a person's eligibility, employment, housing, credit, insurance, education, health, or legal rights;
- upload malware, probe for vulnerabilities, disrupt the Service, access another user's project, scrape at scale, or bypass security, promo, rate, or usage limits;
- reverse engineer or extract models, systems, prompts, or nonpublic components except where law expressly permits it; or
- help another person do any of the above.
We may review, block, remove, or report content and suspend access when we reasonably believe it violates these Terms, threatens the Service or another person, or creates legal or provider risk.
6. Privacy and confidential material
Our Privacy Policy explains how information is handled. Do not upload trade secrets, regulated data, government identifiers, financial credentials, medical records, or other material that requires protections the Service has not expressly agreed in writing to provide. Keep project and delivery links private.
7. Fees, payment, and promotions
Some access may be free, promotional, or limited. If we offer a paid feature, its price, included usage, and any applicable rerun or refund terms will be shown before purchase. Taxes may apply. Payments may be processed by a third party, and you authorize it to charge the payment method you provide. Except where the checkout terms or law say otherwise, fees are nonrefundable once generation has begun because computing resources are committed to your request.
8. Our intellectual property
The Service, website, software, workflow, interfaces, branding, documentation, and all related technology are owned by us or our licensors. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not use Bring Them to Life names, logos, or branding without permission.
9. Feedback
If you give us an idea, suggestion, or other feedback about the Service, you grant us a perpetual, worldwide, nonexclusive, royalty-free right to use it without restriction or compensation. This does not give us rights in your uploaded character or project content.
10. Third-party services
The Service relies on third-party hosting, AI, compute, email, payment, and delivery providers. Their services may be unavailable or change, and their terms may apply to their direct relationship with you. We are not responsible for third-party websites or services that we do not control.
11. Suspension and termination
You may stop using the Service at any time. We may limit, suspend, or terminate access if you violate these Terms, create risk or potential legal exposure, fail to pay an amount due, abuse provider resources, or if continuing the Service is no longer practical. Sections that by their nature should survive termination, including ownership, payment obligations, disclaimers, liability limits, indemnity, and general legal terms, will survive.
12. Disclaimers
To the fullest extent permitted by law, the Service and all Output are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, noninfringement, and any warranty that the Service will be uninterrupted, secure, error-free, or produce a particular result.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, Bring Them to Life and its owners, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, business opportunity, or cost of substitute services, arising from the Service or Output.
Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service during the 12 months before the event giving rise to the claim or (b) US $100. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain exclusions or limits, so part of this section may not apply to you.
14. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Bring Them to Life and its owners, affiliates, and personnel from claims, damages, losses, liabilities, and reasonable legal fees arising from your Input, your use or distribution of Output, your violation of these Terms, or your violation of another person's rights.
15. Copyright complaints
If you believe material processed or made available through the Service infringes your copyright, email hello@bringthemtolife.xyz with your contact information, identification of the copyrighted work and disputed material, the location of that material, a statement of your good-faith belief, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove material and terminate repeat infringers where appropriate.
16. Governing law and disputes
Michigan law governs these Terms, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Washtenaw County, Michigan, and each party consents to those courts. Before filing a claim, please email us and allow 30 days for a good-faith attempt to resolve it. This section does not prevent either party from seeking urgent injunctive relief or using a qualifying small-claims court.
17. Changes to these Terms
We may update these Terms as the Service changes. We will post the revised version and change the effective date. Material changes will apply prospectively, and we will provide additional notice when required. Continuing to use the Service after revised Terms take effect means you accept them.
18. General terms
These Terms and the policies expressly referenced here are the entire agreement about the Service. If one provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
